Account Registration

To use certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Types

• Landlord/Manager Accounts: For property owners and managers who create organizations, add properties, manage leases, and invite tenants.
• Tenant Accounts: For tenants invited by landlords to access their rental information, make payments, and submit maintenance requests.
• Maintenance Accounts: For maintenance personnel assigned to handle work orders and service requests.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

Account Requirements

You must be at least 18 years of age to create an account and use the Services. By creating an account, you represent and warrant that you meet this requirement.

Subscription Plans

We offer various subscription plans with different features and pricing. Current pricing and plan details are available on our website. We reserve the right to modify our pricing at any time, with notice to existing subscribers.

Free Tier

We offer a free tier with limited features. Free accounts are subject to usage limitations and may have access to fewer features than paid plans. We reserve the right to modify or discontinue the free tier at any time.

Billing

Paid subscriptions are billed in advance on a monthly basis. By subscribing to a paid plan, you authorize us to charge your payment method for the applicable fees. Subscription fees are non-refundable except as required by law or as expressly stated in these Terms.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

Failed Payments

If we are unable to charge your payment method, we may retry the charge and/or suspend your access to paid features until payment is received. We reserve the right to terminate accounts with repeatedly failed payments.

Rent Payments

tenant8 facilitates rent payments between tenants and landlords through our payment processing partner, Stripe. When tenants make payments through our platform, funds are processed by Stripe and deposited to the landlord's connected bank account.

Processing Fees

Payment processing fees may apply to transactions. Fee amounts and who bears the cost (landlord or tenant) depend on your subscription plan and settings. Current fee schedules are available in your account dashboard.

Payment Disputes

Disputes regarding rent payments are between landlords and tenants. tenant8 is not a party to any lease agreement and is not responsible for resolving payment disputes. We may provide transaction records to assist in dispute resolution.

Stripe Terms

By using our payment features, you also agree to Stripe's Terms of Service. Stripe's terms govern the processing of payments and the handling of payment information.

Your Content

You retain ownership of all content you submit, post, or display through the Services ("User Content"), including property information, lease documents, messages, and uploaded files.

License to Us

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, store, process, and display your User Content solely for the purpose of providing and improving the Services. This license terminates when you delete your User Content or account, except where retention is required by law.

Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that you have all rights necessary to submit User Content and that your User Content does not violate any third-party rights or applicable laws.

Data Accuracy

You are responsible for ensuring the accuracy of information you enter, including property details, lease terms, rent amounts, and tenant information. We are not responsible for errors or disputes arising from inaccurate information.

Termination by You

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Services will immediately cease.

Termination by Us

We may suspend or terminate your account and access to the Services at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, extended inactivity, or failure to pay fees.

Effect of Termination

Upon termination, your right to access and use the Services will immediately cease. We may delete your account and User Content, though we may retain certain information as required by law or for legitimate business purposes. All provisions of these Terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Data Export

Before terminating your account, you may request an export of your data. We will provide your data in a standard format within a reasonable timeframe.

Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law provisions.

Informal Resolution

Before filing any formal legal action, you agree to first contact us and attempt to resolve the dispute informally by sending a written notice describing the nature of the claim and the relief sought. We will attempt to resolve the dispute within 30 days.

Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Polk County, Iowa. You consent to the personal jurisdiction of such courts.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and tenant8 regarding the Services.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by tenant8.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, acts of war, terrorism, labor disputes, government actions, or internet service provider failures.
